Des Moines, August 25, 2016 — On Monday, September 19, the Iowa Supreme Court will hear oral arguments in Keokuk, Iowa. The proceeding will take place in the Grand Theater, 26 N 6th Street. The oral arguments are open to the public and will begin at 7 p.m.
The court will hear attorneys argue in the following case:
Residential and Agricultural Advisory Committee, et al. v. Dyersville City Council, et al., case no. 15-1413, from Dubuque County district court
Plaintiffs object to the Dyersville City Council's rezoning of land around the "Field of Dreams" baseball site from agricultural to commercial in order to facilitate development of a large youth baseball complex. Plaintiffs contend the council did not act impartially, that it had agreed ahead of the hearing to support rezoning the site, and that it had worked with the developer to facilitate the project prior to the hearing. A primary question before the court is whether the council was acting in a quasi-judicial capacity or in a legislative capacity when deciding the rezoning question.
