Defendants were granted interlocutory appeal of a district court order denying them summary judgment. Defendants contend the court erred in finding plaintiff’s expert witness was qualified to sign the certificate of merit affidavit required by Iowa Code section 147.140 where the expert’s license was in retired/inactive status.
