Case No. 19-1008

Cornelius Davis
v.
Iowa District Court for Scott County

Plaintiff filed a petition for writ of certiorari requesting review of a district court order imposing a monetary sanction for his failure to personally attend a settlement conference. Plaintiff contends: (1) the local rule under which the sanction was imposed does not require a party to personally attend a settlement conference when their counsel is present; (2) the rule is inconsistent with the Iowa Rules of Civil Procedure if it does require a represented party’s personal attendance; (3) the rule does not authorize the sanction; and (4) the district court applied the rule inconsistently in the circumstances of this case. The supreme court granted the petition.
