Case No. 22-1232

State of Iowa
v.
Kyra Rose Bauler

Following a bench trial, Kyra Bauler appeals her convictions for introduction of contraband, a class “D” felony under Iowa Code section 719.7(3)(a), possession of a controlled substance, a class “D” felony under section 124.401(5), and in a separate case, operating while intoxicated, first offense under section 321J.2(2)(a). Bauler appeals the denial of her motions to suppress arguing: (1) because the deputy did not have sufficient cause to stop her car, the stop violated her rights under the Fourth Amendment and article I, section 9 of the Iowa Constitution; (2) the K9 sniff of Bauler’s car violated her right against unreasonable searches because the dog physically trespassed on her cart in conducting the sniff; and (3) the search of her purse without a warrant violated her rights under article I, section 8 and the Fourth Amendment.
