Tunis E. Den Hartog, et. al.

The supreme court has issued opinions in this matter in 2014 and 2017. In this third appeal, Tunis E. Den Hartog and the other plaintiff taxpayers argue (1) the district court erred in finding that the City’s proposed sale complied with the requirements of Iowa Code section 306.23, (2) the district court erred by not finding the City in contemp,; and (3) the supreme court should exercise its authority to remand to the district court for it to compel performance by another under Iowa Code section 661.15.
