The court granted the State's application for further review following a court of appeals decision that concluded the district court erred in refusing to honor Carlos Gomez Garcia's knowing and voluntary waiver of an interpreter. The court reversed the appellant's conviction for delivery of a controlled substance and remanded for a new trial. The State questions whether "every defendant who can show that he/she should have been allowed to waive his/her right to an interpreter is entitled to automatic reversal of his/her convictions."
